These Terms & Conditions govern your access to and use of Voivera ("Service"), operated by Cookie Webster Co., Ltd. ("Voivera", "we", "our", or "us"). By using the Service, you agree to these Terms.
1. Services
Voivera provides software and online tools for real estate businesses, including but not limited to:
- Property listings
- Lead management
- CRM features
- Viewing management
- Websites
- Analytics and reporting
- Rental and sales management
- Short-term booking features
- Payment integrations
- Other related services
Voivera is a software provider only and is not a real estate broker, agent, legal advisor, financial advisor, escrow service, or party to transactions between users and third parties.
2. User Accounts
You are responsible for:
- Maintaining account security.
- Protecting passwords and login credentials.
- Providing accurate information.
- All activities occurring under your account.
3. Subscription and Billing
Subscriptions are billed monthly or annually.
Unless required by law:
- Subscription fees are non-refundable.
- Setup fees are non-refundable once work has commenced.
- Custom development fees are non-refundable.
- Lack of usage does not entitle customers to refunds.
We reserve the right to modify pricing with reasonable notice.
Failure to pay may result in suspension or termination.
4. Cancellation
Customers may cancel their subscription at any time.
Cancellation prevents future billing but does not entitle customers to refunds for unused periods.
Access will remain active until the current paid period expires.
5. User Content
Users retain ownership of information uploaded to the platform.
Users are solely responsible for:
- Listings
- Property descriptions
- Photos
- Documents
- Leads and customer data
- Rental information
- Booking information
Users agree not to upload unlawful, misleading, defamatory, fraudulent, or harmful content.
6. Acceptable Use
Users agree not to:
- Use the Service unlawfully.
- Upload malware or malicious code.
- Attempt unauthorized access.
- Reverse engineer or copy the platform.
- Interfere with system performance.
- Scrape or overload the Service.
- Violate intellectual property rights.
Violation may result in suspension or termination without notice.
7. Data Processing
Customers remain responsible for personal information stored within the Service.
Voivera acts solely as a processor of customer data for the purpose of providing the Service.
We may use trusted third-party providers, including hosting, analytics, email, and payment service providers.
8. Data Backups
Although reasonable backup procedures are performed, customers remain responsible for maintaining copies of important information.
Voivera does not guarantee against accidental loss or corruption of data.
9. Beta Features
Experimental or beta features are provided "as is" and may contain errors or interruptions.
Use of beta features is entirely at your own risk.
10. Availability
We strive to provide reliable service but do not guarantee uninterrupted or error-free operation.
Outages, maintenance, cyberattacks, and failures of third-party providers may affect availability.
11. Third-Party Services
Voivera may integrate with third-party providers.
We are not responsible for the availability, accuracy, or security of third-party services.
12. Intellectual Property
Voivera and all related software, designs, branding, and content remain the property of Cookie Webster Co., Ltd.
No part of the Service may be copied, reproduced, resold, or distributed without written permission.
13. No Warranty
The Service is provided on an "as is" and "as available" basis without warranties of any kind.
14. Limitation of Liability
Voivera shall not be liable for:
- Loss of profits
- Loss of data
- Lost opportunities
- Business interruption
- Indirect or consequential damages
Our maximum liability shall not exceed the fees paid by the customer during the previous twelve months.
15. Indemnification
Users agree to indemnify and hold harmless Voivera, Cookie Webster Co., Ltd., employees, directors, and affiliates from claims, losses, liabilities, and expenses arising from use of the Service or violations of these Terms.
16. Force Majeure
Voivera shall not be liable for failures caused by circumstances beyond our reasonable control, including natural disasters, internet outages, cyberattacks, governmental actions, labor disputes, and third-party service failures.
17. Termination
Accounts violating these Terms may be suspended or terminated.
Customers should export their information before cancellation.
18. Changes
We may revise these Terms periodically.
Continued use constitutes acceptance of revised Terms.
19. Governing Law
These Terms shall be governed by the laws of Thailand.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Phuket, Thailand.
